    HEARING,

    ANNUAL

    MEETING,

    PROPOSITION 1 – ANNUAL BUDGET VOTE,

    & ANNUAL BOARD

    ELECTION

    PROPOSITION 2-CAPITAL IMPROVEMENTS PROJECT, 2025 & PURCHASE OF REAL PROPERTY

    NOTICE IS HEREBY GIVEN, that a Budget Hearing will be held on May 13, 2025, at 5:30 p.m. in the Large Group Instruction Room of the Salamanca High School of the Salamanca City Central School District, Cattaraugus County, Salamanca, New York (the “District”) to inform and present to District residents a detailed written statement regarding the District’s estimated expenditures and revenue for the upcoming school year prior to the budget vote.

    AND FURTHER NOTICE IS HEREBY GIVEN, that the Annual Meeting, Vote and Election (the “Annual Vote and Election”) for qualified voters of the District will be held in the Gymnasium of the Salamanca High School in the District, 50 Iroquois Drive, Salamanca, New York, on Tuesday, May 20, 2025 from 12:00 noon to 9:00 p.m. prevailing time for the purposes of voting on: the 2025-2026 fiscal year budget, the purchase of real property proposition and electing one (1) member of the Board of Education of the District (the “Board”) and transacting such other business as may be authorized by law.

    AND FURTHER NOTICE IS HEREBY GIVEN, that the election of members of the Board shall be held to fill one at-large positions on the Board. The one candidate with the highest number of votes will be assigned a five-year term (July 1, 2025-June 30, 2030).

    AND FURTHER NOTICE IS HEREBY GIVEN, that voting at the Annual Vote and Election shall consist of the Board election, voting on the following propositions, and voting on any other propositions authorized by law and the rules of the Board.

    Proposition No. 1: 2025-2026 Budget

    Shall the following proposition be adopted, to-wit:

    RESOLVED, that the budget for the Salamanca City Central School District, Cattaraugus County, Salamanca, New York (the “District”) for the fiscal year commencing July 1, 2025 and ending June 30, 2026, as presented by the Board of Education, is hereby approved and adopted, and the required funds therefor are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.

    Proposition No. 2: CAPITAL IMPROVEMENTS PROJECT, 2025 AND THE ACQUISITION

    OF PROPERTY

    Shall the following bond resolution of the Board of Education of the Salamanca City School District, Cattaraugus County, New York (the “District”) be approved?

    A BOND RESOLUTION, DATED MARCH 25, 2025, OF THE BOARD OF EDUCATION OF THE SALAMANCA CITY CENTRAL SCHOOL DISTRICT, CATTARAUGUS COUNTY, NEW YORK (THE “DISTRICT”), AUTHORIZING THE DISTRICT (I) TO UNDERTAKE (SUBJECT TO THE APPROVAL OF THE VOTERS OF THE DISTRICT) A CAPITAL IMPROVEMENTS PROJECT CONSISTING PRIMARILY OF (A) THE EXPANSION, RECONSTRUCTION AND RENOVATION, IN PART, AND THE CONSTRUCTION OF ADDITIONS, IMPROVEMENTS AND UPGRADES TO, VARIOUS DISTRICT BUILDINGS AND FACILITIES (AND THE SITES THEREOF) AND (B) THE ACQUISITION OF A CERTAIN PARCEL OF REAL PROPERTY (AND THE ENSUING UPGRADES THERETO) LOCATED AT 4187 KILL BUCK ROAD, SALAMANCA, NEW YORK, ALL AT A MAXIMUM ESTIMATED AGGREGATE COST OF $46,985,000 (COLLECTIVELY, THE “PROJECT”), (II) TO EXPEND TOWARD THE PROJECT (A) $10,000,000 (DURING THE CURRENT FISCAL YEAR OF THE DISTRICT) FROM THE DISTRICT’S CAPITAL IMPROVEMENTS RESERVE FUND, 2022 AND (B) $26,985,000 (CONSISTING OF APPROXIMATELY $21,347,078 OF AVAILABLE DISTRICT FUNDS ON HAND AND $5,637,922 OF NATIVE AMERICAN BUILDING AID ANTICIPATED TO BE RECEIVED) OF DISTRICT FUNDS THAT ARE AVAILABLE OR ANTICIPATED AND (III) TO ISSUE SERIAL BONDS OF THE DISTRICT IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $10,000,000 TO FINANCE THE BALANCE OF THE COST OF THE PROJECT, AND DELEGATING THE POWER TO ISSUE BOND ANTICIPATION NOTES IN ANTICIPATION OF THE SALE OF SUCH OBLIGATIONS TO THE PRESIDENT OF THE BOARD OF EDUCATION OF THE DISTRICT. PLEASE TAKE FURTHER NOTICE that an Environmental Assessment Form has been completed for the Project described in Proposition No. [2] (collectively, the “Project”), which is a Type I Action under SEQRA, a thorough review of the Project’s potential environmental impacts has been undertaken, it has been found that the Project will not result in a significant adverse impact

    AND FURTHER NOTICE IS HEREBY GIVEN, that the Board will have prepared and completed a detailed statement in writing of the amount of money that will be required during the District’s 2025-2026 fiscal year for school purposes, specifying the several purposes and the amount for each. Such statement will be available, upon request, to District residents within the District from the hours of 8:00 a.m. to 3:30 p.m. prevailing time beginning on May 6, 2025 until the Annual Vote and Election, except Saturdays, Sundays, and holidays, at each of the public schoolhouses of the District and the District office.

    AND FURTHER NOTICE IS HEREBY GIVEN, that petitions nominating candidates for the office of member of the Board shall be filed with the District Clerk, which is located in the District Office inside the Salamanca City Central School District, 50 Iroquois Drive, Room 739A Salamanca, New York, between 9:00 a.m. and 5:00 p.m., prevailing time, until not later than 5:00 p.m. on April 30, 2025.

    Vacancies on the Board are not considered separate, specific offices; candidates run at-large. Nominating petitions shall not describe any specific vacancy upon the Board for which the candidate is nominated; shall be directed to the District Clerk; shall be signed by at least 100 qualified voters of the District; shall state the name and residence of each signer, and shall state the name and residence of the candidate.

    AND FURTHER NOTICE IS HEREBY GIVEN, that applications for absentee and early mail ballots for purposes of voting may be obtained at the office of the District Clerk between the hours of 8:00 a.m. and 3:30 p.m., prevailing time. Completed applications must be received by the District Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. A list of persons to whom absentee and early mail ballots are issued will be available for inspection by qualified voters of the District in the office of the District Clerk between the hours of 8:00 a.m. and 3:30 p.m., prevailing time, on each of the five (5) days prior to May 20, 2025, being the day set for the Annual Vote and Election, except Sundays; and such list will be available at the polling place on the day of the Annual Vote and Election . Any qualified voter then present in the polling place may object to the voting of the ballot upon appropriate grounds by making his/her challenge and the reasons therefor known to the Inspectors of Election before the close of the polls. Absentee and early mail ballots must be received by the District Clerk no later than 5:00 p.m. prevailing time on May 20, 2025.

    AND FURTHER NOTICE IS HEREBY GIVEN, that personal registration of voters is required either pursuant to § 2606 of the Education Law or pursuant to Article 5 of the Election Law. If a voter has heretofore registered pursuant to § 2606 of the Education Law and has voted at an annual or special district meeting within the last four (4) calendar years, he or she is eligible to vote at the Annual Vote and Election; if a voter is registered and eligible to vote under Article 5 of the Election Law, or on the Tribal Rolls provided by the Seneca Nation, he or she is also eligible to vote at the Annual Vote and Election. All other persons desiring to vote must register.

    AND FURTHER NOTICE IS HEREBY GIVEN, that the Board of Registration will meet on Tuesday, April 22, 2025 for the purpose of registering all qualified voters of the District pursuant to § 2606 of the Education Law at the Superintendent’s Conference Room, which is located in the District Office inside the Salamanca City Central School District, 50 Iroquois Drive, Salamanca, New York, between the hours of 9:00 a.m. and 4:00 p.m. to add any additional names to the register to be used at the Annual Vote and Election, at which times any person will be entitled to have his or her name placed on such register, provided that at such meeting of the Board of Registration, he or she is known or proven to the satisfaction of said Board of Registration to be then or thereafter entitled to vote at the Annual Vote and Election for which the register is prepared. The register so prepared pursuant to § 2606 of the Education Law will be filed in the District Clerk’s office and will be open for inspection by any qualified voter of the District, upon request, beginning April 22, 2025, between the hours of 8:00 a.m. and 3:30 p.m. prevailing time on weekdays (except holidays) prior to May 20, 2025, and on the day of the Annual Vote and Election; and during each of the five (5) days prior to May 20, 2025, except Sundays.

    AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are not currently registered may apply to register as a qualified voter of the District by requesting and returning a military voter registration application to the District Clerk. Completed military voter registration application forms must be received in the office of the District Clerk no later than 5:00 p.m. on

    April 21, 2025. A military voter may indicate his or her preference for receiving the registration application by mail, facsimile transmission or electronic mail.

    AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are registered voters in the District may apply for a military ballot by requesting an application from the District Clerk. For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application no later than 5:00 p.m. on May 5, 2025. In a request for a military ballot application or ballot, the military voter may indicate his or her preference for receiving the application or ballot by mail, facsimile transmission, or electronic mail.

    AND FURTHER NOTICE IS HEREBY GIVEN, that optical scan voting machines will be used to record the votes on the Board election, the budget, and the other propositions presented.

    AND FURTHER NOTICE IS HEREBY GIVEN, that the District has adopted Rules for the Submission of Questions and Propositions at Annual District Elections. Printed copies of the Rules are available at the District Clerk’s office, which is located in the District Office inside the Salamanca City Central School Distirct, 50 Iroquois Drive. Room 739A, Salamanca, New York.
