PUBLIC HEARING AND VOTE:
NOTICE IS HEREBY GIVEN, that the Annual Meeting and Election ("Annual District Vote") of the Ellicottville Central School District ("District"), Cattaraugus County, New York will be held on Tuesday, May 19, 2026, from 1:00 pm to 8:00 pm in the Elementary School Foyer, located at 5873 Route 219, Ellicottville, New York, for the purposes of: (i) electing one (1) Member to the Board of Education; (ii) voting on the budget for the 2026-2027 fiscal year; (iii) voting on a proposition to authorize the lease of two school buses for each of the next five (5) years; and (iv) transacting such other business as is authorized by law.
NOTICE IS ALSO GIVEN, that a public hearing for the qualified voters of the District will be held on Tuesday, May 12, 2026, commencing at 6:00 pm in the High School Cafeteria of Ellicottville Central School, 5873 Route 219, Ellicottville, New York, for the presentation of the District’s proposed budget for the 2026-27 school year.
NOTICE IS ALSO GIVEN, that voting at the Annual District Vote shall consist of voting on the following propositions, and on each of the other propositions as are authorized by law and the rules of this Board to be voted on at said time:
PROPOSITION NO. 1 –
Basic Budget
Shall the following resolution be adopted, to wit: RESOLVED: That the Board of Education of the Ellicottville Central School District in the County of Cattaraugus, State of New York, BE AND IS HEREBY AUTHORIZED TO EXPEND THE SUM OF $16,899,130 for the 2026-2027 school year budget. The Basic Budget will provide funds for all of the educationally related services and the maintenance of our school building.
PROPOSITION NO. 2 – School Bus Lease
Shall the following resolution be adopted, to wit:
RESOLVED: This proposition will authorize the Board of Education of the Ellicottville Central School District in the County of Cattaraugus, State of New York, to levy an additional (not to exceed) $66,000 to lease 2 (two) 66 passenger school buses for each of the next five years (five annual payments) commencing with the 2026-2027 school year.
PROPOSITION NO. 3 – Renewal of the Transportation Reserve
Shall the following resolution be adopted, to wit:
RESOLVED: This proposition will authorize the Board of Education (the “Board”) of the Ellicottville Central School District, Cattaraugus County, New York (the “District”) to renew the Transportation reserve fund (the “Fund”) for the acquisition of various school buses, school bus-type vans/minivans, and similar vehicles (and related equipment) for use in the transportation program of the District, all pursuant to Section 3651 of the Education Law of the State of New York; that the Fund shall be known as the “Transportation Reserve Fund”; that the ultimate amount of the Fund shall be not greater than $1,000,000.00 (plus interest earned thereon); that the probable term of the Fund shall be not longer than five (5) years; and that the permissible sources from which the Board is authorized to appropriate monies to such Fund from time to time shall be (a) amounts applied thereto from budgetary appropriations of the District; (b) unappropriated fund balance of the District; (c) to the extent specifically directed by the Board, State aid received as reimbursement for transportation-related expenditures by the District (whether or not such expenditures were financed in whole or in part from the Fund); (d) proceeds from the sale of real or personal property owned by the District, if permitted by law and if directed by the Board; and (e) such other sources as the Board or the voters of the District may direct from time to time, all as may be permitted by law.
PROPOSITION NO. 4 – Proposition to use funds from the Transportation Reserve
Shall the following resolution be adopted, to wit:
RESOLVED: This proposition will authorize the Board of Education (the “Board”) of the Ellicottville Central School District, Cattaraugus County, New York (the “District”) to use funds from the Transportation reserve fund (the “Fund”) for the acquisition of various school buses, school bus-type vans/minivans, and similar vehicles (and related equipment) for use in the transportation program of the District, all pursuant to Section 3651 of the Education Law of the State of New York; not to exceed $30,000
NOTICE IS ALSO GIVEN, that the election of a member of the Board of Education shall be held to fill one (1) seat on the Board. The candidate receiving the highest number of votes will serve a five-year term, beginning on July 1, 2026, and expiring on June 30, 2031. Nominating petitions are available in the Office of the District Clerk, between the hours of 7:00 am – 3:30 pm (Monday-Friday) when school is in
session.
NOTICE IS ALSO GIVEN, that all candidates for the office of Member of the Board of Education shall be nominated by petition. Each petition shall be directed to the District Clerk, shall be signed by at least 25 qualified voters of the District or two percent of the voters who voted in the previous annual election of the members of the school board, whichever is greater, shall state the residence of each signer, and shall state the name and residence of the candidate. Each petition must be filed in the Office of the District Clerk between the hours of 7:00 am and 3:30 pm, and not later than 5:00 pm on Monday, April 20, 2026.
NOTICE IS ALSO GIVEN, that applications for absentee ballots and early mail voting ballots may be obtained at the Office of the District Clerk located in the District office between the hours of 7:00 am to 3:30 pm, Monday through Friday, not including holidays. Completed applications must be received by the District Clerk at least seven (7) days before the Annual District Vote, if the ballot is to be mailed to the voter, and one (1) day before the Annual District Vote if the ballot is to be issued personally to the voter. Absentee and early mail voting ballots must be received by the District Clerk not later than 5:00 pm on May 19, 2026 (the day of the Annual District Vote) to be canvassed and counted. A list of all persons to whom absentee and early mail voting ballots have been issued will be available in the Office of the District Clerk, where it shall be open for inspection by any qualified voter of the District between the hours of 7:00 am and 3:30 pm., during the five (5) days immediately preceding the Annual District Vote, except for Sundays, and said list will be posted at the polling place at the election. Any qualified voter may challenge the acceptance of an absentee or early mail voter ballot of any such person on such list by making the challenge and the reasons therefore known to the Inspector of the Election before the close of polls.
NOTICE IS ALSO GIVEN, that military voters who are qualified voters of the District may apply for a military ballot by requesting an application from the District Clerk. For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application no later than 5:00 pm, on Thursday, April 23, 2026. Eligible military voters may designate their preference for receiving their application by mail, facsimile transmission, or electronic mail. If no designation is indicated, the military voter application and ballot will be transmitted by mail. Irrespective of the preferred method of transmission designated by a military voter, a military voter’s original military ballot application and military ballot must be returned by mail or in person to the office of the District Clerk and the ballot received no later than 5:00 PM on May 19, 2026, to be canvassed and counted.
NOTICE IS ALSO GIVEN, that a voting machine(s) will be used to record the vote on the budget, on the propositions, and on the election of members of the Board of Education. The Board has adopted rules for the Use of Voting machines and printed copies for general distribution are available at the office of the District Clerk located at 5873 Route 219, Ellicottville, New York.
NOTICE IS ALSO GIVEN, that pursuant to a rule adopted by the Board under §§2035 and 2008 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at the Annual District Vote must comply with the Board’s adopted rules set forth in District Policy 1650. However, the Board will not entertain any petition to place before the voters any proposition the purpose of which is not within
the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the proposition requires the expenditure of monies. Printed copies of the policy are available at the office of the District Clerk at 5873 Route 219, Ellicottville, New York.
FURTHER NOTICE IS HEREBY GIVEN, that the Board of Education of this District will have prepared and completed a detailed statement in writing of the amount of money which will be required during the 2026-2027 fiscal year for school purposes, specifying the several purposes and the amount for each. Such statement shall be completed at least seven (7) days before the budget hearing at which it is to be presented and copies thereof shall be prepared and made available, upon request, to residents within the District during the period of seven (7) days before the budget hearing, the fourteen (14) days immediately preceding the Annual District Vote, and the day of the Annual District Vote, and may be obtained by any resident in the District at each school house in the District in which school is maintained during the hours of 7:00 am to 3:30 pm on and after May 4, 2027, excluding Saturdays and Sundays and in the District Office.
